5. Service activation and provisioning

Shared, Reseller, WordPress and Application Hosting

Shared, reseller, WordPress and application hosting accounts may be automatically provisioned following successful receipt and confirmation of payment.

Once payment has been confirmed, our systems may automatically create the relevant account and send the applicable account or setup information to the customer.

Orders may occasionally be placed in a pending status for manual review, including for security, fraud prevention, payment verification or other operational reasons.

Where an order requires manual review, provisioning may be delayed until the review has been completed.

VPS, Cloud, Dedicated Servers and Other Services

VPS, cloud, dedicated server and other services that require manual provisioning will normally be provisioned within 48 hours following receipt and confirmation of the initial payment.

The stated provisioning period is an estimate and may be affected by availability, configuration requirements, third-party providers, payment verification, technical issues or other circumstances outside our reasonable control.

Where there is a significant delay, we will make reasonable efforts to communicate this to the customer.

6. Domains

Domain registrations and transfers are subject to the rules, policies and requirements of the relevant domain registry or registrar.

Registering a domain name does not guarantee permanent ownership or availability of that domain.

You are responsible for ensuring that the domain information you provide is accurate and up to date.

Domain registration fees, renewal fees, transfer fees and other applicable charges must be paid in accordance with the pricing applicable at the time.

Certain domain extensions may have additional registration, transfer, renewal, verification or eligibility requirements.

We may suspend, cancel or otherwise restrict a domain where required by the relevant registry, registrar, applicable law, court order, dispute resolution process or where payment has not been received.

7. Payments and billing

Services are provided subject to payment of the applicable fees.

Unless otherwise stated, payment must be received before a service is activated or renewed.

Prices displayed on the Website may change from time to time. Any applicable taxes, government charges, registry fees or third-party charges may be payable in addition to the advertised price where applicable.

Our hosting services must not be used for activities that are unlawful, fraudulent, abusive or that materially threaten the security, availability or integrity of our infrastructure.

You must not use our services to:

9.1. distribute malware, viruses, ransomware or other malicious software;

9.2. conduct phishing, credential theft, hacking or unauthorised access;

9.3. operate fraudulent websites or services;

9.4. host content that is illegal under applicable law;

9.5. distribute copyrighted material without the necessary rights or permission;

9.6. conduct activities designed to disrupt networks, servers or third-party services;

9.7. send unsolicited bulk email or operate spam services;

9.8. conduct denial-of-service attacks or similar abusive activities;

9.9. operate services that intentionally consume unreasonable or excessive system resources in a manner that negatively affects other customers or our infrastructure; or

9.10. otherwise use the service in a way that materially compromises the security, performance or availability of our systems or other customers’ services.

Where we reasonably believe that a service is being used in violation of these requirements, we may investigate and take appropriate action, including suspension or restriction of the affected service.

Where reasonably possible and appropriate, we will contact the customer before taking action. However, immediate suspension may be necessary where there is an urgent security, legal, fraud or abuse risk.

10. Customer content and responsibility

You are responsible for all websites, files, applications, databases, email content, data and other material uploaded, stored or transmitted through your hosting account.

You are responsible for ensuring that your content complies with applicable laws and that you have the necessary rights, licences and permissions to use it.

You are also responsible for maintaining appropriate backups of your data unless a specific backup service has been purchased and its terms expressly provide otherwise.

While we may operate backup systems for operational or disaster recovery purposes, backups should not automatically be regarded as a substitute for customer-maintained backups.

11. Suspension and termination

We may suspend or terminate a service where:

• Payment remains overdue.

• The service is being used for unlawful or fraudulent activity.

• The service presents a security risk to our infrastructure or other customers.

• The customer materially breaches these Terms and Conditions.

• We are required to do so by law, a competent authority, registry or other authorised body.

• The service is being used for abuse, spam, attacks or other prohibited activity.

• Continued provision of the service would create a significant operational, security or legal risk.

Where circumstances permit, we will provide reasonable notice before suspension or termination.

In urgent circumstances, including serious security threats, fraud, unlawful activity or attacks against our infrastructure or third parties, we may suspend a service immediately.

Termination or suspension does not remove any payment obligations that arose before the effective date of termination.

12. Intellectual Property

We are the owner or licensee of the intellectual property rights in the Website and its content, unless otherwise stated.

This includes the Website’s design, layout, text, graphics, images, logos, software, documentation and other materials.
