Hosting Terms
Last updated: September 2026
Please read these General Terms and Conditions carefully before ordering or using any services provided by Galactik Hosting. They contain important information about your rights, responsibilities and obligations.
These General Terms and Conditions, together with any applicable service-specific terms, policies and schedules referred to in them, form the agreement between you and Galactik Hosting for the services you purchase.
By creating an account, placing an order or using our services, you confirm that you have read, understood and agree to be bound by these General Terms and Conditions.
We recommend that you keep a copy of these Terms for your records.
1. About Us and These General Terms
1.1 About us
“Galactik Hosting”, “we”, “us” or “our” refers to the hosting and domain services business operated by Galactik IT Solutions.
Galactik Hosting provides web hosting, domain registration, SSL certificates, VPS, dedicated servers and related online services.
1.2 These General Terms
These General Terms govern your purchase and use of services provided by Galactik Hosting through our website, customer portal or other approved ordering channels.
By registering for an account, placing an order or using our services, you agree to be legally bound by these General Terms and any applicable service-specific terms.
1.3 Service-specific terms
Certain services may be subject to additional terms, schedules or policies. These may include:
Acceptable Use Policy;
Fair Usage Policy;
Domain Registration Terms;
SSL Certificate Terms;
Refund and Cancellation Policy;
Privacy Policy;
service-specific terms displayed during ordering; and
terms imposed by third-party registrars, certificate authorities, software providers or other service providers.
Where you purchase a service to which additional terms apply, those terms form part of your agreement with us.
1.4 Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, business practices, technology, legal requirements or other relevant circumstances.
Where appropriate, material changes will be communicated through our website, customer portal or by email.
Your continued use of the services after the effective date of revised Terms constitutes acceptance of the revised Terms, unless applicable law requires otherwise.
1.5 Definitions and interpretation
In these Terms:
“Account” means your Galactik Hosting customer account used to order, manage and administer services.

2. Age and Eligibility
You must be at least 18 years old to register an account and purchase Services from Galactik Hosting.
If you are placing an Order on behalf of a company, organisation or other entity, you confirm that you have the authority to enter into the Agreement on its behalf.
We may request additional information or verification where reasonably necessary to establish your identity, account ownership or eligibility to use a particular Service.
3. Effect of These Terms
3.1 Application
These Terms apply to all Orders and Agreements for Services supplied by Galactik Hosting.
By submitting an Order, you confirm your acceptance of the Terms applicable to that Order.
3.2 Your own terms
Any terms or conditions supplied by you will not apply unless expressly accepted by us in writing.
3.3 Entire agreement
For each Service, the Agreement consists of:
these General Terms;
the applicable service-specific terms and policies;
the Order;
the Order Acceptance;
applicable pricing and service information displayed at the time of purchase; and
our Privacy Policy.
3.4 Authority
If you purchase Services for a business or organisation, you confirm that you have authority to bind that business or organisation to these Terms.
3.5 Conflict
If there is a conflict between documents forming part of the Agreement, the following order of precedence applies:
the Order Acceptance;
any specific written agreement between you and Galactik Hosting;
these General Terms; and
applicable service-specific schedules and policies.
4. Registration for an Account
4.1 Account requirement
You may browse the Galactik Hosting website without an Account.
An Account is required to order and manage most Services through our customer portal.
Your Account may allow you to:
place and manage Orders;
view invoices;
make payments;
manage domains;
manage hosting Services;
submit support tickets;
update account information; and
access other functions made available through the customer portal.
4.2 Accurate information
You must provide accurate, complete and current information when registering your Account.
You must update your information when it changes.
We may suspend or restrict an Account where the information provided is materially false, misleading, unverifiable or deliberately incomplete.
4.3 Account security
You are responsible for maintaining the confidentiality of your login credentials.
You must:
use a secure password;
not share your password unnecessarily;
notify us promptly if you suspect unauthorised access;
change compromised credentials as soon as possible; and
take reasonable steps to secure devices used to access your Account.
You are responsible for activity carried out through your Account where that activity results from your failure to properly protect your login credentials.
4.4 Valid email address
You must maintain an active email address that you regularly monitor.
We may use this address for:
invoices;
renewal notices;
service notifications;
security notices;
support communications;
account verification; and
other important communications concerning your Services.
4.5 Account rejection
We reserve the right to refuse an Account or Order where we reasonably believe that doing so is necessary to protect our systems, customers, service providers or legal interests.
5. Placing an Order and Formation of an Agreement
5.1 Selecting Services
You may select Services through our website, customer portal, quotation process or another approved ordering method.
5.2 Order information
Before submitting an Order through our website or customer portal, you will generally be shown the Services selected and the applicable Fees.
You are responsible for checking the information before submitting the Order.
5.3 Order as an offer
Submitting an Order constitutes a request to purchase the selected Services. It does not necessarily mean that we have accepted the Order.
We may decline an Order for reasonable operational, technical, security, compliance, availability or other legitimate reasons.
5.4 Payment
Unless otherwise agreed in writing, applicable Fees must be paid in advance.
Available payment methods will be displayed during the ordering process or on the applicable invoice.
We are not required to activate a Service until the required payment has been successfully received or otherwise confirmed.
5.5 Order acceptance
An automated Order acknowledgement, invoice or payment receipt does not necessarily constitute acceptance of an Order.
An Agreement is formed when we accept the Order and confirm the Service, whether through an Order Acceptance, service activation or other confirmation.
5.6 Order changes
If you discover an error in your Order, you should contact us as soon as possible.
Changes may not be possible after a Service has been provisioned, registered, issued or activated. Where a change is possible, additional charges may apply.
6. Provision of Services
6.1 Service activation
Where a Service is automatically provisioned, activation may take place following successful payment and completion of any required verification.
Some Services, including certain VPS, dedicated server and manually configured Services, may require additional provisioning time.
6.2 Service term
Unless otherwise stated, the Service remains active for the period for which it has been purchased and paid.
Renewal may be subject to payment of the applicable renewal Fee.
6.3 Our responsibilities
We will use reasonable skill and care when providing the Services.
We will make reasonable efforts to maintain the operation of our infrastructure and respond to legitimate technical support requests.
6.4 No guarantee of particular results
Unless expressly stated in writing, we do not guarantee that a Service will meet every individual requirement or support every application, website, software package or configuration.
You are responsible for determining whether a Service is suitable for your intended use.
6.5 Unlimited services and resources
Where any Service or feature is described as “unlimited”, “unmetered” or similar, that description is subject to:
reasonable and fair use;
the applicable service specifications;
our Acceptable Use Policy;
our Fair Usage Policy;
technical limitations of the Service; and
the requirement that use must not adversely affect our infrastructure or other customers.
“Unlimited” does not mean that a Service may be used as general-purpose file storage, backup storage, archival storage or in a manner that materially interferes with the operation of our infrastructure.
6.6 Service availability
We use reasonable efforts to keep Services available and operational.
However, we do not guarantee uninterrupted or error-free operation unless a particular availability commitment has been expressly agreed in writing.
Service availability may be affected by:
scheduled maintenance;
emergency maintenance;
network failures;
upstream provider failures;
software failures;
cyberattacks;
hardware failures;
events outside our reasonable control; or
actions or omissions by the customer.
6.7 Maintenance and improvements
We may carry out maintenance, upgrades, repairs, security work and infrastructure changes from time to time.
Where reasonably practicable, we will provide advance notice of planned maintenance that is expected to materially affect Services.
6.8 Monitoring
We may monitor our infrastructure and Services for security, performance, abuse, resource usage, service availability and operational purposes.
We may use our own monitoring systems and technical records when assessing the operation and performance of our infrastructure.
6.9 Service migration
We may move a Service between servers, data centres, networks, infrastructure providers or technical environments where reasonably necessary to operate, maintain, secure or improve the Service.
Where such a change materially affects your Service, we will provide notice where reasonably practicable.
6.10 Third-party infrastructure
Some Services may depend on third-party infrastructure, networks, registrars, certificate authorities, software providers, data centres or other suppliers.
Where a third party is involved, the availability and operation of the relevant part of the Service may also be subject to that third party’s terms and limitations.
7. Your Obligations
You agree to:
provide accurate and current information;
cooperate with us when reasonably required to provide or troubleshoot a Service;
provide information reasonably required to investigate faults;
report suspected faults or security incidents promptly;
report suspected abuse involving our Services;
keep your Account credentials secure;
maintain suitable internet connectivity and equipment to access the Services;
ensure that you have the technical knowledge reasonably necessary to operate your Service;
ensure that Material uploaded to our infrastructure is suitable for the Service;
maintain appropriate backups of your Material;
ensure that you have all necessary rights, permissions and licences for Material you upload or host;
comply with all applicable laws and regulations; and
comply with these Terms and the Acceptable Use Policy.
8. Acceptable Use and Prohibited Activities
You must use the Services lawfully and responsibly.
You must not use the Services to:
send spam or unsolicited bulk email;
distribute malware, viruses, ransomware or other malicious software;
conduct phishing or credential theft;
gain unauthorised access to systems or networks;
conduct denial-of-service or distributed denial-of-service attacks;
interfere with another customer’s Service;
host or distribute material that infringes another person’s intellectual property rights;
engage in fraud or other unlawful activity;
impersonate another person or organisation;
distribute abusive, threatening or unlawfully discriminatory content;
exploit or facilitate the exploitation of children;
operate prohibited proxy, traffic relay or anonymisation services where these adversely affect our infrastructure;
operate cryptocurrency mining or other resource-intensive activities where prohibited by the applicable Service;
operate public file-sharing or similar infrastructure contrary to our Fair Usage Policy;
use hosting accounts primarily for backups or archival storage where such use is prohibited;
operate gaming, IRC, chatbot, torrent or similar services on plans that do not permit them;
deliberately circumvent resource limits or security controls; or
otherwise breach our Acceptable Use Policy.
Our Acceptable Use Policy forms part of these Terms.
Where there is a specific conflict between these General Terms and the Acceptable Use Policy, the provision specifically applicable to the prohibited use will apply.
9. Backups and Data
9.1 Your responsibility for backups
You are responsible for maintaining current and reliable backups of your websites, databases, email, files and other Material.
You should not rely solely on any backup facilities that may be included with a Service.
9.2 Backups provided by Galactik Hosting
Where backups are included with a particular Service, they are intended as a recovery facility and do not replace your own independent backups unless expressly agreed otherwise.
Backup availability may depend on the Service, infrastructure, retention period and technical circumstances.
9.3 Restoration
Where a backup is available, we may be able to assist with restoration.
Restoration may be subject to additional charges depending on the Service, amount of data and work required.
9.4 Data loss
We are not responsible for loss or corruption of Material resulting from your failure to maintain appropriate independent backups, except to the extent liability cannot lawfully be excluded.
10. Support Services
10.1 Support
We provide customer and technical support through the support channels made available to customers, including the customer portal and ticketing system.
We will use reasonable efforts to respond to support requests within a reasonable time.
10.2 Scope of support
Support may include assistance with:
hosting-related technical issues;
service configuration;
account-related issues;
DNS-related issues;
basic hosting control panel matters;
service availability issues; and
other matters reasonably connected with the Services.
10.3 Exclusions
Unless specifically included in your Service, Support Services do not necessarily include:
website development;
website content changes;
extensive website troubleshooting;
fixing third-party software;
recovery of lost data where no usable backup exists;
custom application development;
malware removal;
extensive server administration;
third-party software licensing issues; or
work caused by your failure to comply with these Terms.
We may provide assistance with these matters at our discretion and may charge for additional work.
11. Third-Party Services and Software
Galactik Hosting may provide access to or resell products and services supplied by third parties.
These may include software licences, SSL certificates, domain registration services, control panels and other third-party services.
Your use of such services may be subject to the third party’s own terms and conditions.
We are not responsible for changes, interruptions or discontinuation of third-party products outside our reasonable control.
Where a third-party provider requires you to deal directly with them for support, verification or technical matters, we may refer you to that provider.
12. Fees, Invoicing and Payment
12.1 Fees
Fees are displayed on our website, customer portal, quotations or invoices and may vary depending on the Service and billing term selected.
Unless expressly stated otherwise, applicable taxes or government charges may be added where required by law.
12.2 Payment in advance
Hosting, domains, SSL certificates and many other Services are normally payable in advance.
12.3 Renewal
Where a Service is renewable, the applicable renewal Fee must be paid by the renewal date to avoid interruption, suspension or expiration.
Domain names are subject to the applicable domain registry’s renewal and expiration rules.
12.4 Late payment
If an invoice remains unpaid after its due date, we may suspend or restrict the relevant Service.
Where an account remains unpaid for an extended period, we may terminate the affected Service and delete associated data in accordance with these Terms.
12.5 Fee changes
We may change our Fees from time to time.
For recurring Services, a revised Fee will normally apply from the next renewal or billing period after the change, unless otherwise stated.
12.6 Chargebacks and payment disputes
If you believe a payment has been made incorrectly or there is a billing dispute, you should contact us promptly through our support channels.
We encourage customers to resolve genuine billing disputes with us before initiating a payment reversal or chargeback.
Where a payment is reversed without a valid basis, we may suspend the affected Services while the matter is investigated.
We reserve the right to recover reasonable costs directly arising from an unjustified payment reversal, to the extent permitted by law.
13. Domain Registrations
13.1 Domain registration
We may provide domain registration and renewal services through our domain registrar partners and upstream registries.
A domain registration is subject to the rules and policies of the relevant domain registry.
13.2 Domain availability
A domain name is not guaranteed to be available until the registration has been successfully completed.
If a domain cannot be registered because it is unavailable or rejected by the relevant registry, we will address the matter in accordance with our applicable domain and refund policies.
13.3 Accurate registration information
You must provide accurate and current information required for domain registration.
You are responsible for ensuring that the information associated with your domain remains accurate.
13.4 Registry requirements
Different domain extensions may have different eligibility, verification, documentation and renewal requirements.
You agree to comply with the applicable requirements of the relevant registry.
13.5 Domain ownership
Registration of a domain does not transfer ownership of Galactik Hosting or any third-party registry rights to you.
Your rights in a domain are subject to the applicable registry rules and the terms under which the domain has been registered.
13.6 Domain expiry
If a domain is not renewed before its expiry date, it may expire, be suspended, enter a grace or redemption period, or become available for registration by another party, depending on the applicable registry.
You are responsible for ensuring that domains are renewed on time.
14. SSL Certificates
SSL certificates may be supplied directly or through third-party certificate authorities.
Certificate issuance is subject to the requirements of the relevant certificate authority.
We cannot guarantee that a certificate authority will approve or issue a certificate.
SSL certificate fees may be non-refundable once a certificate has been issued or the certificate authority has begun processing the request, subject to applicable law and our Refund and Cancellation Policy.
15. Suspension of Services
We may suspend some or all Services where reasonably necessary, including where:
an invoice is overdue;
your use of the Services breaches these Terms;
your use creates a security risk;
your Service consumes excessive or abnormal resources;
your website or account has been compromised;
your Service is involved in spam, phishing, malware or other abuse;
your use adversely affects other customers;
we receive a valid legal or regulatory request;
a third-party provider requires suspension;
suspension is necessary for emergency maintenance or security; or
we reasonably believe suspension is necessary to protect our infrastructure, customers or business.
Where reasonably practicable, we will notify you of the reason for suspension and provide an opportunity to remedy the issue.
However, we may suspend a Service immediately where delay could create a security, legal, operational or financial risk.
16. Termination
16.1 Termination by you
You may request cancellation of a Service through the customer portal or another cancellation method we make available.
Cancellation requests do not necessarily result in an immediate termination unless the Service or applicable cancellation process states otherwise.
16.2 Termination by us
We may terminate a Service or Agreement where:
you materially breach these Terms;
you fail to pay amounts due;
you repeatedly breach our Acceptable Use Policy;
your use creates a serious risk to our infrastructure or customers;
we are legally required to do so;
a third-party provider discontinues a required service;
continuing the Service becomes commercially or technically impractical; or
you become insolvent or cease trading where applicable.
16.3 Immediate termination
We may terminate a Service without further notice where the breach is serious, unlawful, fraudulent, malicious or creates an immediate threat to our infrastructure, customers or third parties.
17. Cancellation and Refunds
Refund eligibility depends on the Service purchased, the reason for cancellation and our applicable Refund and Cancellation Policy.
17.1 Non-refundable services
Certain Services may be non-refundable once provisioned or issued. These may include:
domain registrations and renewals;
SSL certificates once issued;
third-party licences;
certain server provisioning costs;
bespoke or manually configured Services; and
other Services expressly identified as non-refundable at the time of purchase.
17.2 Annual Services
Where a Service has been paid for annually in advance, cancellation does not automatically create a right to a refund for the unused portion unless required by applicable law or expressly agreed by us.
17.3 Service cancellation
To cancel a Service, you should submit a cancellation request through your customer account or the cancellation method specified by Galactik Hosting.
17.4 Refund method
Where a refund is approved, we will normally process it using the original payment method where practicable.
18. Effect of Termination
When a Service or Agreement ends:
the relevant Services may cease;
access to the relevant hosting account may be disabled;
Material may be deleted following termination and any applicable retention period;
you remain responsible for outstanding amounts incurred before termination; and
provisions that are intended to survive termination will continue to apply.
You are responsible for downloading or transferring your Material before termination.
We are not required to retain your Material indefinitely after a Service has ended.
19. Intellectual Property Rights
19.1 Our intellectual property
Galactik Hosting and/or Galactik IT Solutions retain all Intellectual Property Rights in:
our website;
customer portal;
software and systems;
service documentation;
branding;
logos;
website content;
proprietary tools;
infrastructure configurations; and
other materials supplied by us.
You may not copy, reproduce, modify, distribute or commercially exploit our intellectual property without our prior written permission, except where permitted by law.
19.2 Your Material
You retain ownership of Intellectual Property Rights in Material that belongs to you.
You grant Galactik Hosting a non-exclusive right to store, process, transmit, reproduce and otherwise handle that Material only to the extent reasonably necessary to provide, maintain, secure and support the Services.
19.3 Your responsibility
You are responsible for ensuring that your Material does not infringe the rights of another person or organisation.
20. Data Protection and Privacy
We process personal information in accordance with our Privacy Policy and applicable data protection laws.
You acknowledge that providing Services may require us to process information relating to your Account, billing, domains, technical configuration, support requests and Service usage.
Where you use our hosting infrastructure to process personal data belonging to your own customers or users, you remain responsible for ensuring that your use of that data complies with applicable data protection requirements.
Our Privacy Policy forms part of these Terms.
21. Security
You are responsible for securing applications, websites and accounts that you operate through the Services.
This includes keeping software, CMS platforms, plugins, themes, scripts and applications appropriately updated where applicable.
We may take action against compromised or malicious Services where necessary to protect our infrastructure and other customers.
This may include:
isolating an account;
disabling a compromised application;
blocking malicious traffic;
suspending a Service; or
requiring remediation before restoring access.
22. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Subject to that:
22.1 General limitation
We will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
22.2 Excluded losses
To the fullest extent permitted by law, we will not be liable for:
loss of profits;
loss of revenue;
loss of business;
loss of contracts;
loss of anticipated savings;
loss of goodwill;
loss of reputation;
loss of opportunity;
business interruption; or
indirect or consequential loss.
22.3 Data
You acknowledge that internet-based Services carry inherent risks of data loss, corruption, compromise and interruption.
You are therefore responsible for maintaining independent backups of your Material.
22.4 Third parties
We are not responsible for failures caused by third-party providers, registries, networks, certificate authorities, software vendors or other external providers where those failures are outside our reasonable control.
22.5 Maximum liability
To the fullest extent permitted by applicable law, our total aggregate liability arising from a particular Service or Agreement will not exceed the total Fees actually paid by you for that Service during the 12 months immediately preceding the event giving rise to the claim.
This limitation does not apply where liability cannot lawfully be limited or excluded.
23. Your Indemnity
You agree to indemnify Galactik Hosting and Galactik IT Solutions against reasonable claims, losses, damages, costs and expenses arising from:
your breach of these Terms;
your unlawful use of the Services;
infringement of third-party rights by your Material;
your violation of our Acceptable Use Policy;
misuse of your Account;
your failure to maintain appropriate security; or
claims arising from Material hosted or transmitted through your Services.
This provision applies to the extent permitted by applicable law.
24. Events Outside Our Control
We will not be responsible for failure or delay caused by circumstances beyond our reasonable control.
These may include:
natural disasters;
fire or flooding;
power failures;
telecommunications failures;
internet backbone failures;
major cyberattacks;
war or civil unrest;
government action;
epidemics or pandemics;
industrial disputes;
failures of data centres or upstream providers; or
other circumstances outside our reasonable control.
Where such an event affects the Services, we will use reasonable efforts to restore normal operation as soon as practicable.
25. Notices and Communications
We may communicate with you using:
email;
your customer portal;
support tickets;
notices displayed on our website; or
other contact information associated with your Account.
You are responsible for ensuring that the contact information associated with your Account remains accurate.
26. Complaints and Dispute Resolution
If you have a complaint about a Service, you should first contact Galactik Hosting through our customer support channels.
We will review the complaint and seek to resolve it within a reasonable period.
Where a complaint cannot be resolved through normal support, you may request escalation to management.
We encourage customers to give us a reasonable opportunity to investigate and resolve complaints before commencing external proceedings, except where urgent legal action or another legal remedy is appropriate.
27. Records
We may retain records relating to Orders, invoices, payments, customer accounts, support requests and Agreements for as long as reasonably necessary for business, legal, accounting, security and regulatory purposes.
You should retain copies of important invoices, Orders and service information for your own records.
28. General
28.1 Third-party rights
A person who is not a party to an Agreement has no rights to enforce its provisions unless applicable law provides otherwise.
28.2 Assignment by you
You may not transfer your Agreement or Service to another person without our prior written consent, except where the transfer is expressly permitted by the applicable Service.
28.3 Assignment by us
We may transfer or assign our rights and obligations under an Agreement to another business or service provider where reasonably necessary, provided this does not materially reduce your contractual rights.
28.4 Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
28.5 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
28.6 No partnership
Nothing in these Terms creates a partnership, joint venture, employment relationship or agency relationship between you and Galactik Hosting.
28.7 Entire agreement
These Terms and the documents expressly incorporated into them constitute the agreement between you and Galactik Hosting concerning the relevant Services.
29. Governing Law and Jurisdiction
These Terms and any Agreement between you and Galactik Hosting are governed by the laws of Kenya, except where mandatory applicable law provides otherwise.
Subject to any mandatory legal rights available to a Consumer, the courts of Kenya shall have jurisdiction over disputes arising from or relating to these Terms or the Services.
