Acceptable Usage Policy

Last Updated: 15 September 2026

This Acceptable Use Policy (“AUP”) sets out the rules and conditions governing your use of hosting, domain registration, email, VPS, dedicated server, SSL and other related services provided by Galactik Hosting.

In this AUP, “you”, “your” or “customer” refers to the person, business or organisation using our Services, including any employee, agent, contractor, representative or other person authorised by you to access or use your account.

“Galactik Hosting”, “we”, “us” or “our” refers to Galactik Hosting, the hosting and domain services division operated by Galactik IT Solutions.

This AUP forms part of our Terms & Conditions and applies to all Services provided by us. By purchasing, accessing or using our Services, you agree to comply with this AUP.

Where you allow another person to access or use your account, you remain responsible for activity carried out through that account, whether or not we were directly informed of the arrangement.

1. General Requirements

You are responsible for all content, files, applications, databases, email accounts and other material uploaded, stored, transmitted or made available through your Services.

You represent and warrant that:

  • You have the legal right, licence or permission to use and host all content placed on our infrastructure.

  • Your content does not infringe the copyright, trademark, privacy, intellectual property or other legal rights of any person or organisation.

You are responsible for determining whether your website, application, business or online activity requires any licence, permit, registration or regulatory approval.

2. Prohibited Content and Activities

You must not use our Services to host, store, transmit, distribute, publish, promote or facilitate content or activities that are unlawful, fraudulent, malicious or abusive.

Prohibited activities include, but are not limited to, the following.

This includes fraud, theft, unauthorised access to computer systems, identity theft, money laundering, cybercrime and other unlawful activities.

You must not use our Services to:

  • Gain unauthorised access to computers, networks, systems or accounts.

Security testing, penetration testing and similar activities may only be conducted against systems that you own or where you have appropriate authorisation.

2.4 Fraud, Phishing and Impersonation

You must not use our Services to conduct or facilitate:

  • Other activities intended to deceive or defraud individuals or organisations

2.5 Copyright and Intellectual Property Infringement

You must not use our Services to host, distribute or facilitate access to content that infringes another person’s intellectual property rights.

This includes:

  • Pirated software

  • Cracked software

  • Licence bypass tools

  • Unauthorised copies of copyrighted works

  • Warez

  • Unauthorised films, music, books or publications

  • Unauthorised game files

  • Copyright-infringing download or distribution services

You are responsible for obtaining and maintaining all licences required for content and software hosted on your account.

2.6 Child Sexual Abuse and Exploitation Material

Any material involving the sexual exploitation or abuse of children is strictly prohibited.

Where such material is identified, we may immediately suspend or terminate the affected Service and may preserve or disclose relevant information to law enforcement or other competent authorities where required or permitted by law.

2.7 Harassment, Threats and Abusive Activities

You must not use our Services to facilitate serious harassment, threats, targeted abuse or unlawful intimidation.

We may take action where content or activity creates a credible risk of harm to individuals, organisations, our customers, our infrastructure or third parties.

This provision does not prohibit lawful criticism, journalism, political discussion or other lawful expression.

2.8 Unlawful or Regulated Activities

You are responsible for obtaining any licences, permits or regulatory approvals required for your business or activities.

We may suspend or restrict Services where we reasonably believe that they are being used for unlawful or unauthorised regulated activities.

3. Network and Infrastructure Abuse

You must not use our infrastructure in a manner that materially affects our network, servers, other customers or third parties.

Prohibited activities include:

  • DDoS attacks

  • Participation in botnets

  • Unauthorised network scanning

  • Port scanning against third-party systems

  • IP spoofing

  • Deliberate attempts to compromise network infrastructure

  • Excessive automated requests

  • Deliberately generating abnormal traffic

  • Cryptocurrency mining on shared hosting

  • Processes that continuously consume excessive resources

  • Activities that cause repeated blacklisting of our IP addresses

  • Attempts to bypass technical or security controls

  • Deliberate interference with other customers’ Services

We may take immediate action where necessary to protect our infrastructure, customers or third parties.

4. Shared Hosting Resource Usage

Shared hosting is designed for websites, business applications and other normal web hosting activities.

You must not use shared hosting as a substitute for a VPS or dedicated server where your website or application requires sustained or unusually high computing resources.

Resource limits may apply to your hosting account, including CPU, RAM, entry processes, concurrent processes, disk I/O, storage, inodes, databases and other resources.

Resource limits vary according to the applicable hosting plan.

Where an account consistently consumes excessive resources, we may:

  1. Contact you and request optimisation;

  2. Temporarily restrict the affected resource;

  3. Recommend migration to a more appropriate hosting plan;

  4. Suspend the affected application or account; or

  5. Terminate the affected Service in serious or repeated cases.

Where reasonably possible, we will give you an opportunity to resolve excessive resource usage. However, immediate action may be taken where continued activity threatens server stability, security or other customers.

5. Prohibited Shared Hosting Uses

Unless expressly permitted under your Service, shared hosting must not be used primarily as:

  • A general-purpose file storage service;

  • A file-sharing service;

  • A cloud storage platform;

  • A backup storage facility;

  • A public download mirror;

  • A software distribution platform;

  • A proxy service;

  • A VPN or traffic tunnelling service;

  • A torrent tracker or peer-to-peer file-sharing service;

  • A gaming server;

  • An IRC server;

  • A mail relay;

  • A cryptocurrency mining platform;

  • A service for continuously running background processes or daemons.

Files required for the normal operation of a website or application are permitted.

However, a hosting account must not be used primarily to store files that have no legitimate connection to an active website or application.

6. Storage and Disk Usage

Your use of disk space is subject to the limits and specifications of your hosting plan.

Where a hosting plan is advertised as providing unmetered bandwidth or another unmetered resource, this does not mean that the resource may be used without reasonable limitations.

Unmetered services remain subject to fair use and the technical limitations of the Service.

You must not use hosting primarily as an archive or general-purpose storage facility.

We may require you to remove unnecessary files or migrate to a more appropriate Service where your storage usage is excessive or inconsistent with the intended use of your hosting plan.

7. Email and Anti-Spam Policy

You must not use Galactik Hosting’s email infrastructure to send spam, unsolicited bulk email or abusive electronic communications.

You must not:

  • Send unsolicited bulk email.

  • Use harvested email addresses.

  • Purchase or use email lists where you do not have the necessary permission to contact recipients.

  • Forge or manipulate email headers.

  • Impersonate another sender.

  • Operate an unauthorised mail relay.

  • Send phishing emails.

  • Send malware or malicious attachments.

  • Use compromised websites or mailboxes to send spam.

  • Deliberately circumvent email sending limits.

  • Use our infrastructure to support spam campaigns.

  • Continue sending messages to recipients who have appropriately opted out.

Marketing and bulk email must comply with applicable Kenyan law and recognised email delivery standards.

7.1 Email Sending Limits

Email sending limits may apply to your hosting plan.

These limits exist to protect our mail infrastructure, server performance, IP reputation and email deliverability.

We may restrict outgoing email where an account generates excessive:

  • Messages

  • Bounces

  • Spam complaints

  • Failed deliveries

  • Authentication failures

  • Other indicators of abusive or compromised email activity

7.2 Compromised Mailboxes

If a mailbox, website or account is compromised and used to send spam or malicious email, we may temporarily restrict outgoing mail until the issue has been resolved.

The customer is responsible for securing the affected account.

7.3 Spam Enforcement

Where we reasonably believe that an account has been deliberately or recklessly used for spam, we may:

  • Restrict outgoing email;

  • Suspend affected mailboxes;

  • Suspend the hosting account;

  • Require corrective action;

  • Block malicious scripts;

  • Terminate the affected Service; and

  • Report suspected unlawful activity to appropriate authorities where required or permitted.

8. Website and Application Security

You are responsible for maintaining the security of websites and applications hosted through your account.

This includes keeping software reasonably up to date and taking appropriate security precautions.

You should:

  • Use strong and unique passwords.

  • Keep CMS platforms, plugins, themes and applications updated.

  • Remove unused software.

  • Restrict administrator access.

  • Use appropriate authentication controls.

  • Monitor your website for compromise.

  • Maintain independent backups.

  • Remove malware promptly when detected.

If a compromised website or application poses a threat to our infrastructure or other customers, we may temporarily suspend the affected Service until the security issue has been addressed.

9. Backups

You remain responsible for maintaining independent backups of your website, databases, email and other important data.

Where Galactik Hosting provides backups as part of a Service, such backups are provided as an additional recovery facility and should not be treated as your only backup.

Backup frequency, retention and availability depend on the applicable Service.

We do not guarantee that every file, database, email message, account configuration or other item will be included in every backup.

Accounts may be excluded from automated backups where technical, storage, resource or security considerations make backup impractical.

We may also modify backup schedules, retention periods and exclusions where reasonably necessary to maintain the reliability and performance of our backup infrastructure.

9.1 Customer Backups

You should maintain an independent, off-site backup of important data.

Customers should not rely solely on backups maintained by Galactik Hosting.

Where restoration is requested following deletion, cancellation, suspension, termination or other account changes, restoration may be subject to availability and additional charges.

9.2 VPS Backups

Unless expressly included in your VPS plan or purchased as a separate service, VPS Services do not include guaranteed automated backups.

VPS customers are responsible for implementing and maintaining their own off-site backup solution.

Any infrastructure-level backup or snapshot that may be taken by us for operational or redundancy purposes does not constitute a guaranteed customer backup service.

VPS restoration requests may incur additional charges depending on the work and resources required.

10. Reseller Hosting

If you purchase a reseller hosting service, you may resell hosting Services only under the terms of the applicable reseller plan.

As a reseller, you are responsible for your customers and the activity conducted through accounts you create.

You must:

  • Ensure your customers comply with this AUP.

  • Monitor accounts under your reseller service.

  • Respond appropriately to abuse complaints.

  • Remove or suspend accounts that breach applicable terms.

  • Ensure that your use of the reseller platform remains within the limits of your plan.

  • Maintain appropriate records relating to your customers where required by law.

We may suspend individual accounts or the reseller account where necessary to address serious abuse, security risks or repeated violations.

11. VPS Services

VPS customers have greater control over their server environment and are therefore responsible for a greater level of system administration.

You are responsible for:

  • Securing your VPS;

  • Managing installed software;

  • Applying appropriate security updates;

  • Managing user accounts and passwords;

  • Configuring security controls where appropriate;

  • Monitoring resource usage;

  • Preventing abuse from applications running on your VPS; and

  • Maintaining independent backups.

11.1 Unmanaged VPS

An unmanaged VPS does not include routine server administration.

You are responsible for operating system configuration, software installation, updates, security, optimisation and troubleshooting unless otherwise agreed.

11.2 Managed VPS

Managed VPS Services include only the level of management specified in the applicable Service plan.

Management does not automatically include development, application programming, third-party software support or fixing customer-developed code.

12. Third-Party Software

Our Services may include or provide access to third-party software and technologies such as cPanel, Softaculous, LiteSpeed, Imunify360 and other applications.

Third-party software is subject to its own licences, terms and conditions.

We do not guarantee that third-party software will remain available, compatible or error-free.

You are responsible for ensuring that software, themes, plugins, applications and other third-party materials installed on your account are properly licensed.

13. Support Fair Use

Our technical support is primarily intended to assist with Services provided and managed by Galactik Hosting.

Depending on your Service, support may include assistance relating to:

  • Hosting availability;

  • Hosting configuration;

  • Domain services;

  • Email services;

  • Server connectivity;

  • cPanel-related issues;

  • Basic hosting configuration;

  • Server-related problems.

Unless expressly included in your Service, support does not generally include:

  • Website development;

  • Custom programming;

  • Debugging customer-developed code;

  • Designing websites;

  • Managing third-party applications;

  • Fixing unsupported software;

  • Search engine optimisation;

  • Content creation;

  • General IT consultancy.

Where a support request falls outside the scope of your Service, we may offer the work as a separately chargeable service where available.

We reserve the right to restrict abusive, repetitive or excessive support requests.

14. Account Security

You are responsible for maintaining the confidentiality of your account credentials.

You must:

  • Keep passwords secure;

  • Avoid sharing credentials unnecessarily;

  • Use strong passwords;

  • Enable available security features where appropriate; and

  • Notify us promptly if you suspect unauthorised access.

You are responsible for activity carried out through your account unless you can demonstrate that the activity occurred without your authorisation and despite reasonable security measures.

If we identify suspicious activity, we may require password changes or temporarily restrict access to protect your account and our infrastructure.

15. Monitoring and Abuse Prevention

We may monitor technical information relating to our Services for purposes including:

  • Maintaining system security;

  • Detecting abuse;

  • Protecting our infrastructure;

  • Preventing fraud;

  • Investigating security incidents;

  • Maintaining service reliability;

  • Responding to complaints; and

  • Complying with legal obligations.

We do not routinely inspect customer website content for general monitoring purposes.

However, we may access or process account information where reasonably necessary for technical support, security investigations, abuse prevention, legal compliance or protection of our customers and infrastructure.

16. Suspension and Termination

We may suspend or terminate a Service where we reasonably believe that:

  • You have breached this AUP;

  • You have breached our Terms & Conditions;

  • Your account is being used for illegal activity;

  • Your account presents a security risk;

  • Your activity is harming our infrastructure or other customers;

  • Your account is involved in spam, phishing, malware or other abuse;

  • Continued operation exposes us to significant legal or regulatory risk;

  • Suspension or termination is required by a competent authority; or

  • You have failed to take reasonable corrective action following notification.

Where circumstances permit, we may notify you and provide a reasonable opportunity to remedy the breach.

However, we may suspend or terminate Services immediately where necessary to protect our infrastructure, customers or third parties, or where the activity is serious or unlawful.

Suspension or termination under this AUP does not remove any payment obligations that arose before suspension or termination.

17. Data and Information Following Suspension

Following suspension or termination, access to account data may be restricted.

You are responsible for maintaining independent backups and retrieving any data you need before termination where reasonably possible.

We may retain or delete account data in accordance with our Terms & Conditions, backup procedures, legal obligations and operational requirements.

We do not guarantee that data will remain available following termination.

18. Intellectual Property

You retain ownership of content that you lawfully upload to your account.

By using our Services, you grant Galactik Hosting a limited, non-exclusive right to store, transmit, process, reproduce and technically cache your content where reasonably necessary to provide, operate, secure and maintain the Services.

This does not transfer ownership of your content to Galactik Hosting.

You remain responsible for ensuring that you have the necessary rights to host and process the content you upload.

19. Privacy and Data Protection

Galactik Hosting will handle personal data in accordance with applicable data protection laws, including the Data Protection Act, 2019 of Kenya, where applicable.

Where you use our Services to collect, store or process personal data belonging to your customers, employees, website users or other individuals, you are responsible for ensuring that your processing activities comply with applicable law.

You must not use our Services to unlawfully collect, disclose, process or distribute personal information.

Our Privacy Policy provides additional information regarding the processing of personal data.

20. Law Enforcement and Legal Requests

Galactik Hosting may cooperate with courts, law enforcement agencies, regulators and other competent authorities where required or permitted by law.

Where legally required, we may provide information in our possession relating to an account, customer or Service.

We may also preserve relevant information where reasonably necessary in connection with a security incident, investigation, legal proceeding or valid legal request.

We will handle such requests in accordance with applicable law.

21. Abuse Complaints

If you believe a website, email account, server or other Service hosted through Galactik Hosting is being used unlawfully or in breach of this AUP, you may report the matter through our official support channels.

We may investigate credible complaints and may request additional information from the affected customer.

We will determine the appropriate action based on the circumstances, available evidence, applicable law and our contractual obligations.

22. Fair Usage

Our Services are intended for legitimate hosting, website, application, email, business and related online activities.

Where a Service is described as “unmetered”, “unlimited” or similar, such terminology does not mean that the Service may be used without reasonable restrictions.

Fair usage restrictions may apply where activity:

  • Materially affects other customers;

  • Places unreasonable or sustained demand on shared infrastructure;

  • Uses the Service primarily for storage or file distribution;

  • Attempts to circumvent technical limitations;

  • Creates a security or operational risk; or

  • Is inconsistent with the intended purpose of the Service.

Where possible, we will work with the customer to identify an appropriate solution, which may include optimisation or migration to a different Service.

23. Changes to This Policy

We may update this AUP from time to time to reflect:

  • Changes to our Services;

  • Changes in technology;

  • New security threats;

  • Changes in applicable law;

  • Changes to our infrastructure; or

  • Changes to industry practices.

The updated version will be published through our website or otherwise communicated to customers where appropriate.

Your continued use of the Services following the effective date of an updated AUP constitutes acceptance of the revised policy, subject to any rights you may have under applicable law or our Terms & Conditions.

24. Severability

If any provision of this AUP is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it valid where possible.

The remaining provisions shall continue to apply.

25. No Waiver

Failure by Galactik Hosting to enforce any provision of this AUP on one occasion does not constitute a waiver of our right to enforce that provision on a subsequent occasion.

26. Governing Law

This AUP shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

Any dispute relating to this AUP shall be handled in accordance with the dispute resolution provisions contained in our Terms & Conditions.

Where court proceedings are necessary, the matter shall be subject to the jurisdiction of the competent courts of Kenya.

27. Contact

If you have questions about this Acceptable Use Policy or wish to report suspected abuse involving a Galactik Hosting Service, please contact us through the official support channels provided on the Galactik Hosting website.

This Acceptable Use Policy forms part of the Galactik Hosting Terms & Conditions and applies to all Services unless a specific Service agreement expressly provides otherwise.
